Passenger in a road traffic accident receives £2520.00 personal injury compensation

The client was a passenger in a vehicle which the car in front slowed down to turn onto a side road. The car in front set off and then hesitated. The driver of the client’s vehicle collided into the rear of the car in front. After being recommended to Clearwater Solicitors by a friend Mr G contacted our personal injury solicitors who specialise in claiming compensation following car accidents.

The case was taken on by Sara Kiran who specialises in obtaining personal injury compensation for accident victims.

–        Upon receiving the offer on £2520.00 to settle the claim from the third party insurer we contacted our client.

–        We advised our client that the offer was on the low side as his claim was worth £2500.00 to £2800.00.

–        We advised our client there was an element of risk in pursuing the claim further but we would be willing to continue to Court if required.

Mr G decided he did not wish to take the risk and therefore accepted the offer.

This case was very straightforward, the third party insurers accepted liability immediately meaning the claim avoided any unnecessary delays. Although the medical evidence suggested the offer was low the reason we advised our client to accept this offer was because if the matter went to court and if a lower amount was awarded could mean our client could be liable to pay the costs.

We advise our clients not to risk gaining a few hundred pounds because they could potentially be liable to pay hundreds in costs. We could have obtained insurance to cover Mr G which would cost approximately £200 to £300.00. Unfortunately, due to the governments changed in April 2013 the cost of the insurance would not be recoverable from the Defendant’s insurance but would have been deducted from Mr G’s compensation.

Our client’s best interest is our paramount concern at Clearwater Solicitors and therefore we recommend the offer was accepted as our client would not have benefited and settlement would have been delayed by a number of months.
