Question: I was shopping in Tesco when I slipped over some food and injured my back. Can I make a compensation claim?
Answer: You may be able to make a compensation claim, but our personal injury solicitors will need more information. Fill in our online enquiry form or call us on 08000 430 430 to get started.
Tesco has a duty of care towards its workforce and its customers, and must take all reasonably practicable steps to prevent accidents from occurring in its supermarkets. Slips on food in Tesco can be prevented by proper cleaning systems and effective management – food and other mess should be cleaned up quickly and in a safe manner before it leads to preventable accidents. Some of the food that Tesco sells can make a floor seriously slippery, such as wet fruit, yoghurt or cooking oil.
However, it is not always possible to make a compensation claim after slipping on food in Tesco; in some cases it may be argued that the accident was not preventable. This might be the case if the food you slipped on fell to the floor just before you slipped on it – Tesco could claim that the food could not have reasonably be cleaned up in the brief moments it was on the floor.
It could also be argued that the accident did not happen, so you should report the accident to Tesco and ensure they record it in the accident book. Take photographs of the scene of the accident, if possible, as this evidence can support your claim. Tesco could claim that you did not suffer any actual injuries in the fall, so you should go to the doctor or hospital to have your back injuries examined by a healthcare professional and treated.
You should contact Clearwater Solicitors as soon as possible to start making your compensation claim. Dial our freephone number on 08000 430 430 to speak with one of our experts today, or fill in our online enquiry form and we will call you back as soon as possible.
