Question: I was in the nightclub ‘Revolution’ when I slipped in the toilets and injured my back. Is it possible for me to make a compensation claim?
Answer: You can claim compensation for slipping in nightclub toilets if you can demonstrate that the slip was partially or entirely due to the negligence of the nightclub or its staff. Nightclubs have a duty of care towards their staff and customers, and if you are injured in a preventable accident on their premises, then you may be eligible to claim compensation against the company. You should speak with a personal injury solicitor to discuss your nightclub toilets slip accident and begin the process of making a compensation claim.
Nightclubs should clean their toilets and inspect them for slipping hazards regularly, and should take all reasonable steps to prevent slips from happening. While slippery flooring is a common problem in nightclub toilets, dealing with this hazard is simple and only requires proper cleaning systems and regular risk assessments. However, nightclubs cannot prevent all slips in their toilet – if the floor became hazardous immediately before you slipped, then it could be argued that Revolution or its employees could not have dealt with the hazard before your accident occurred, and you may be unable to prove the company’s negligence or claim compensation.
In other instances, it could be claimed that you are partially responsible for the accident. For instance, if the nightclub put up warning signs which you ignored, or if you did not receive prompt treatment for your injuries, then the overall size of your compensation claim could be reduced due to this ‘contributory negligence’.
You should report the accident to staff at Revolution and ensure they make a record of your statement in the accident book. Do not accept any unsolicited compensation settlements the nightclub’s insurers make – instead, wait until you have spoken with personal injury solicitors before you accept any offers.
