Mr Govind is awarded compensation after sustaining injury after a bus was involved in an accident.

Accident Circumstances

Mr Govind was catching the bus from his local bus station in Edgeware to work. He got on the bus and sat at the rear.The driver of the bus was not paying attention to the road and he collided into the rear of the vehicle in front.The third party driver entered the bus and started to argue with the driver. The bus driver apologised to the third party and exchanged their details.

The bus driver did not attend to his passengers after the road traffic accident to see if any of them had any injuries. He was only speaking to the third party driver.Mr Govind had suffered mild injuries to the neck and also the back.At this point Mr Govind got up and phoned his friend from work. Luckily his friend was only five minutes away. Mr Govind exited the bus took photos of both the vehicles and took down their registration numbers.The case was accepted by Clearwater Solicitors and it was allocated to Miss Kiran to pursue a claim for a bus accident compensation claim.Miss Kiran submitted the claim to the third party insurers.

Defendants Position

The third party insurers were given 21 days to respond to the claim after it had been submitted onto the portal.Within one day the third party responded to Miss Kiran and they accepted the claim via the portal. Ten days later they admitted liability.

How we resolved the case

As liability was admitted Miss Kiran was arranging for the client to be examined by a medical expert. However, before he was sent for an examination the third party made an offer to settle his passenger claim. This was to minimise costs and also to settle the claim quickly.

The offer for the general damages was £1300. The third party gave Miss Kiran 14 days to liaise with Mr Govind and revert back to them either rejecting or accepting the offer. Miss Kiran advised Mr Govind he should reject the offer as he had not been medically examined and he could be under settling his claim.Mr Govind was happy with the figure and decided to accept the offer.
