Payment Options In Personal Injury Claims
12th November 2013
If you want to claim compensation for a personal injury or an illness that you believe was caused by negligence, you should speak with Clearwater Solicitors for impartial, sympathetic and honest advice. Call 08000 430 430 or fill in our online enquiry form to get in touch.
We will not charge you a penny for your initial consultation with our personal injury solicitors. We will take this opportunity to find out about your case and if you have a claim. We will also discuss our payment options.
As legal aid is not available in the majority of personal injury claims – excluding those medical negligence claims in which an infant was seriously disabled and other claims with an exceptional public interest value – we will need to discuss other ways of paying for our legal services with you. At Clearwater Solicitors, we have a range of different payment options that should meet everyone’s needs.
No win no fee claims
Conditional fee arrangements, or no win no fee claims, are when any legal fees only become payable under particular circumstances, such as if you win in court, reach an out-of-court settlement, or decide to not go through with the claim half-way through. If you lose the claim, you may have to pay the defendant’s legal costs, and you might want to take out insurance to cover yourself in this situation. This insurance will be non-recoverable. No win no fee solicitors and insurers will generally only go through with supporting a claim or providing cover if they think the claimant has a good chance of success. You may already have an insurance policy that will cover you in this event – we can help you find out.
In some circumstances, the cost of your legal representation can be completely recovered from the losing party, so you will receive every penny of your compensation. In other situations, we will discuss the size of our legal fees during the initial consultation. The overall cost of our fees in a no win no fee claim should not be higher than 25% of the overall compensation settlement, excluding any expenses required to pay for your future requirements.
We offer a cash advance of up to £1,500 to our claimants, which can be used to pay for our legal services or for other expenses relating to the personal injury claim. This advance is repayable upon completion of the claim. This allows us to ensure that everyone has access to our specialist legal services, regardless of their chances of success or their financial background.
Some unions and employee groups fund certain personal injury claims for their members. If you are a member of any of these organisations, Clearwater Solicitors will find out if they will help you fund your case.
Personal savings and insurance cover
It is entirely possible for people to fund cases out of their own personal savings, or to see if their insurance provider will pay for their compensation claim.
